Reservation Terms
These Reservation Terms (the "Terms") constitute a legally binding agreement between you and Street 86 Systems, Inc. ("Street 86", "we," "our," or "us") governing your reservation of a totally.nyc email address (including native.nyc, currently.nyc, formerly.nyc, and always.nyc). These Terms do not govern the activated email service, which will be subject to separate Terms of Service upon launch.
By reserving an address or submitting a Validation Fee, you agree to be bound by these Terms. If you do not agree, do not reserve an address.
1. Eligibility
1.1 Domain-Specific Requirements
Each totally.nyc domain is available exclusively to individuals with a qualifying connection to New York City, as follows:
- native.nyc — available exclusively to individuals born in one of the five boroughs of New York City: Manhattan, Brooklyn, Queens, the Bronx, or Staten Island.
- currently.nyc — available exclusively to individuals who currently reside in one of the five boroughs.
- formerly.nyc — available exclusively to individuals who have previously resided in one of the five boroughs.
- always.nyc — available exclusively to individuals who have resided in one of the five boroughs.
Use of the reservation system by any person not meeting the applicable criteria is strictly prohibited and constitutes a material breach of these Terms.
1.2 Age Requirement
You must be at least 18 years of age to reserve an address. By submitting a reservation, you represent that you meet this requirement.
1.3 Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at security@totally.nyc if you become aware of any unauthorized use of your account.
2. Address Reservation
2.1 Validation Fee
To reserve an address, you must submit a non-refundable validation fee of $5.00 USD ("Validation Fee") via the payment method specified at checkout. Payment is processed by Stripe, Inc. on our behalf. By submitting the Validation Fee, you acknowledge that it is non-refundable under all circumstances.
2.2 Address Format
Addresses are reserved in firstname.lastname format. If your firstname.lastname address is unavailable, you may reserve firstname.middlename.lastname. The name you reserve must correspond to your legal name as it appears on your qualifying documentation. Addresses using nicknames, aliases, or names that do not match your documentation will not be activated. We may, at our discretion, make reasonable exceptions or offer additional address formats.
2.3 Reservation Period
Your reserved address will be held exclusively for you from the date of your Validation Fee through the earlier of: (a) the date on which you complete activation; (b) the date on which your reservation is cancelled; or (c) the date on which your address is released pursuant to Section 4 of these Terms.
3. Eligibility Representation and Verification
3.1 Representation at Reservation
By completing a reservation and submitting the Validation Fee, you represent that you meet the eligibility requirements for the domain you are reserving. This representation is a material condition of your reservation. A false representation constitutes fraud and entitles Street 86 Systems to pursue all available legal remedies.
3.2 Verification Process
During the account creation process, you may be required to complete a document-based verification step. This may involve submitting a photograph or scan of a qualifying document to a third-party verification service designated by Street 86 Systems. Acceptable documents may include a New York City birth certificate or other official documentation establishing your place of birth or residence. We do not retain copies of your verification documents. Verification is handled by the third-party service, which returns only a pass or fail result to us along with required metadata (including validated name and location).
3.3 Contested Eligibility
We reserve the right, at any time and in our sole discretion, to contest the validity of your eligibility representation. If your eligibility is contested, we may require you to provide additional documentation within 30 days of our written request. Acceptable documentation may include, but is not limited to:
- A certified copy of your New York City birth certificate issued by the NYC Department of Health and Mental Hygiene;
- A hospital birth record establishing a New York City borough as the place of birth;
- A utility bill or lease showing residence in a New York City borough; or
- Such other official documentation as we may reasonably specify.
3.4 Failure to Verify
If you fail to provide the requested documentation, or if the documentation provided does not establish your qualifying connection to New York City to our satisfaction, your reservation will be cancelled and your address released permanently. You will not be entitled to a refund of the Validation Fee.
4. Reservation Release
Your reserved address may be released upon: (a) your written cancellation; (b) failure to complete account creation or verification within any deadline we establish; (c) a determination that your eligibility representation is false or your documentation insufficient; or (d) fraud or misrepresentation in connection with your reservation. Released addresses may be made available to others at our discretion.
5. Governing Law
These Terms are governed by the laws of the State of New York, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in New York County, and you consent to the personal jurisdiction of such courts.
6. Modifications
We reserve the right to modify these Terms at any time prior to activation of your address. We will provide notice of material changes by email or by prominent notice on our website no less than 14 days before the changes take effect.
